Contemporaneous Voting:
With respect to the Elections of Officers and Members of the 26th Council arrangements are being made for ballots to be cast in
Port of Spain at the Hall of Justice, Convocation Hall
Tobago at the High Court in Room TG04, (the ‘video-conferencing’ room)
San Fernando at the High Court in the Masters Court Room, with a live-feed being transmitted to Room SFo6 (the ‘video-conferencing’ room)
Procedure at Elections:
There will be staggered voting where the polls for the Executive Officers (that is, President, Vice President and Treasurer) will be closed, counted and provisionally declared before the polls for the Ordinary Members (that is, the 10 senior ordinary members and the 5 junior ordinary members) are closed.
To best ensure the integrity of the voting process the Council has put in place a number of arrangements and mechanisms, further to the power/jurisdiction vested in it by Rules 1, 5 and 26 of Part A of the First Schedule to the Legal Profession Act Chap 90:03. In these circumstances we ask that you kindly Take Notice of the following:
Voting Times and Sequence of Polls:
Please note the following time-sequence for the conduct of Elections-
3:05pm – Once the meeting has been called to order, and after the reports have been tabled, we hope to have a Returning Officer appointed, and have the Polls declared open. Thereafter the Meeting would discuss and/or pass resolutions with respect to Agenda Items. However as long as the Polls have been declared (and remains) open members would be free to cast their ballots at any time.
4:15pm - Ballots for the Executive Officers will be handed out up until 4:15pm. If it is that you wish to participate in the democratic process please make every attempt to arrive at the Voting Rooms before this time. Ballots for the Ordinary Members would continue to be handed out.
4:20pm: We aim to close-off voting for the Executive Officers no later than 4:20pm, and begin the counting thereafter. The Returning Officer would make announcements 10 minutes and 5 minutes before the close of Poll.
5:00pm: Voting for the ten posts of Senior Ordinary Member and five Junior Ordinary Member would be extended to a reasonable period (about fifteen minutes, subject to the discretion of the Returning Officer) after the results for the Executive Posts have been provisionally announced. We have estimated that this would be closed-off at 5:00pm. Again the Returning Officer would make announcements.
If it is that you were the holder of a Practicing Certificate for the 2010-2011 Law Term, and you made your required annual payments (that is, annual subscription to the Association and annual contribution to the Compensation Fund for non-Law Officers, and annual subscription only for Law Officers) with respect to the 2011-2012 Law Term, before 22nd June, your name should be on said list. If it is that you made these payments on or after 22nd June, then your name would not be on the List; you may still be able to attend and vote but in order to do so you would have to walk with –
(a) A copy of your Practicing Certificate for the 2010-2011 Law Term and
(b) The receipt from the High Court registry in respect of the annual payments for the 2011-2012 Law Term.
Law Officers who are Practitioner Members but not in financial standing, may attend but would not be allowed to vote (further to the judgment of the Court of Appeal handed down on in Civ Ap 22/2012 Nabie & Mayers –v- LATT).
